Information we may collect

Personal Data, means any information that identifies, relates to, describes, is reasonably capable of being associated with, or could reasonably be linked, directly or indirectly, with a particular consumer or household and any information relating to an identified or identifiable natural person who can be identified, directly or indirectly.

We may collect and process certain Personal Data about you in a variety of circumstances, which we list below along with the legal basis on which we rely for validly collecting and/or processing the data in question:

• Identity and Contact Data. Personal Data that you provide by filling in forms and using our Services, and which may be amended from time to time. This includes Personal Data provided at the time of registering to use our Services or for attendance at our events, subscribing to our Services, and posting material or requesting further Services, like your name, business address and contact information. We may also ask you for information when you report a problem with our sites or Services.

Legal basis: The information we collect is necessary for us to perform our contractual obligations when we use it to fulfil orders of products and services you have made. However, where you have provided information to us on our sites for other purposes any marketing of our products and services to you using that information will be done on the basis of our legitimate interest in promoting products and services that are most likely to be of interest to you.

• Survey Data. We may also ask you to complete surveys that we use for research purposes, although you do not have to respond to them. We retain your survey answers when you decide to participate in our surveys.

Legal basis: You will have given us your consent when you fill out the relevant survey.

• Cookie Data. We also collect data about your use of our sites and Services by using cookies. More information about how we use cookies is set out at Section 4(b) below.

Legal basis: You have given your consent to our use of cookies via the cookie banner that appears on the websites when you enter. You can choose which cookies to accept in accordance with the instruction given in Section 4(b) below. However, some cookies – identified in Section 4(b) – are necessary for our legitimate interest in ensuring that the Services we provide to you are administered correctly.

• Transactional Data. We also collect commercial information from you, like the details of transactions you carry out through our sites and of the fulfilment of your orders when you use our Services.

Legal Basis: The provision of your Personal Data for these activities is a contractual obligation. You are free to choose not to provide your Personal Data to us, but in the absence of the requested Personal Data, it will not be possible for us to finalise or execute the contract and your requests.

• Usage Data. We also collect usage information when you use our Services, like details of your visits to our sites including, but not limited to, traffic data, location data, weblogs and other communication data, whether this is required for our own billing purposes or otherwise and the resources that you access.

Legal basis: Our collection and use of your Personal Data is necessary for our legitimate interest in ensuring that the service we provide to you is managed correctly.

• Tracking Data. When you visit our sites or use our Services, we may track your use of our sites by data enrichment and analytics tools to help us improve them and to market those products and services that are most relevant to you. This tracking includes, but is not limited to:
  • tracking data about how you came to the relevant sites;
  • the date and time of your visit;
  • pages or subjects you viewed or searched for;
  • page response times, download errors, length of visits to certain pages, page interaction data (such as scrolling, clicks, and mouse-overs), and
  • methods used to browse away from the page.

Most of this data will not be connected to you as an individual.

Legal basis: Our use of your Personal Data is necessary for our legitimate interest in ensuring that the Services we provide to you is managed correctly.

• Public Profile Data. We sometimes use reputable third-party data enrichment providers such as Bombora, who obtain Personal Data about you from publicly available sources and from other third parties who share your Personal Data with your consent. They then match this information against our own customer records.

Legal Basis:

IP ADDRESSES

We may collect information about your computer, including, but not limited to, your IP address, operating system and browser type, for system administration and to report aggregate information to our advertisers. This is statistical data about our users’ browsing actions and patterns and does not identify any individual.

How we collect your data

(a) Information You Provide When Using Our Services:

Whenever you register to a purchase an online subscription of our products or use our Services,  we may collect certain Personal Data such as your name, your email address and other contact details. The same will apply if you:

• join online forums;
• register to attend a conference or other event; or
• request a newsletter/bulletin.

You may be asked during the course of your submission of the online forms, register for events, or otherwise use our Services whether you consent to the disclosure of your Personal Data to third parties, to which you are free to object.

(b) Cookies

Cookies are small pieces of information stored on your device by the web browser of your device. We use cookies placed on your devices to collect data about your use of our sites and the Services. Sometimes we use the Personal Data you provide to us to identify you when you visit our sites or use our Services on different devices. There are three main categories of cookie that we or third parties use when you use the sites or our Services:

These cookies cannot track your browsing activity on other websites. We use these cookies to improve your experience while using our Services.

• Targeting and advertising cookies

We use third party cookies to serve you with advertisements that we believe are relevant to you and your interests. You may see these advertisements on our websites or while using our Services, and on other websites that you visit. We use these cookies serve you advertisements that we believe are more relevant to you.  You may see these advertisments on both our websites and other websites you visit.  We also enable some advertising partners to set cookies specifically to enable them to analyse advertising campaign performance.

(c) Telephone

We provide some Services by telephone and in doing so can collect Personal Data. When possible, the telephone contact is confirmed by sending a message allowing the person concerned to keep a written record of the conversation and to be able to exercise their rights at any time. We do not record telephone calls except to the extent that our journalists require a permanent record of a call for the purposes of newsgathering (provided this is consistent with our Editorial Code).

(d) From a third party

From time to time, we may obtain certain Personal Data about you from third parties, including our trusted partnerships with service providers and where we operate accounts on third-party platforms, such as payment processors, email and live chat platforms, CMS and CRM platforms, advertising networks, e-commerce platforms, webcasting and virtual event platforms, event management and ticketing platforms, survey systems, analytics and performance platforms, employee recruiting platforms, and social media platforms. In the event that we obtain this Personal Data from a third party we will:

• enter into a contract with the applicable third party that complies with the requirements of GDPR;
• inform the individuals concerned of the transfer of their data to us, its source and the means by which they can exercise their rights under GDPR.

Where we store your personal data

The Personal Data that we collect from you may be transferred to, and stored at, a destination outside the European Economic Area^[1] (“EEA”). It may also be processed by staff operating outside the EEA working for us or for one of our suppliers. Those staff may be engaged in, among other things, the fulfilment of your order, the processing of your payment details and the provision of support services. By submitting your Personal Data to us, you agree to this transfer, storing or processing. We will take all steps reasonably necessary to ensure that your data is treated securely and in accordance with this Policy, and the requirements of the Act. For instance, any recipients of your Personal Data based outside the EEA that are not categorised by the European Commission as having adequate data protection legal and regulatory regimes must sign the Commission’s Standard Contractual Clauses.

Uses made of the information

We use Personal Data held about you (and permit certain third party contractors and sub-contractors to use that information) in the following ways, all of which enable us to market our products and services to you and to ensure that we are able to perform legal and contractual obligations:

• To ensure that content from our Services is presented in the most effective manner for you and for your computer;
• To provide you with information, products or services that you request from us or which we feel may interest you;
• To respond to your requests or feedback in written, electronic, or verbal form;
• To manage our customer relationship with you;
• To obtain payment for Services or products that we provide to you;
• To analyse how you use our Services in order to enhance them and make them more relevant to you;
• To carry out our obligations arising from any contracts entered into between you and us, including, but not limited to, ensuring that third party contractors fulfil orders you have made and you thereby receive the service you have previously requested;
• For verification of data lists and other information;
• To allow you to participate in interactive features of our Services, when you choose to do so;
• As part of our recruitment efforts and the employee application process;
• For our internal business purposes, such as complying with our internal policies or business practices, project management, or improving the sites or Services;
• As necessary to comply with legal requirements, to enforce our Terms of Use and Code of Conduct, to prevent fraud, to co-operate with law enforcement and regulatory authorities, and to stop other prohibited, illegal, or harmful activities;
• For purposes disclosed at the time you provide us your information or otherwise set forth in this Policy; and
• To notify you about changes to our Services.

We may also use your data, or permit selected third parties to use your data, to provide you with information about goods and services which may be of interest to you and we or they may contact you about these by post, email or telephone.

If you are an existing customer, we will only contact you by electronic means with information about goods and/or services similar to those in which you have previously expressed an interest.

How we protect your data

We endeavour to incorporate reasonable safeguards to help protect and secure your Personal Data.  To that end, we have put in place various security procedures and technical and organisational measures to safeguard your Personal Data, which include, without limitation, firewalls, encryption and passwords.

All Personal Data you provide to us is stored on our secure servers. Any payment transactions will be encrypted. Where we have given you (or where you have chosen) a password which enables you to access certain parts of our sites, or use our Services, you are responsible for keeping this password confidential. We ask you not to share a password with anyone.

Unfortunately, the transmission of information via the internet is not completely secure. Although we will do our best to protect your Personal Data, we cannot guarantee the security of your data transmitted to our sites; any transmission is at your own risk. Once we have received your information, we will use strict procedures and security features to try to prevent unauthorised access.

Disclosure of your information within the Group

We may disclose your Personal Data to any member of our Group who may use the Personal Data for the purposes described above.

How we share your personal data with third parties

We share your Personal Data with select third parties only in the ways that are described in this Policy and with our business partners, suppliers and sub-contractors in order to provide you with our Services and perform any contract we enter into with them or you.

(a)       Third Parties with Your Consent.

With your consent, we my share your Personal Data with event and webinar sponsors, content providers whose content you choose to view on this website, and carefully selected third parties to contact your about their products and services.  Some of foregoing may be located outside the European Economic Area, but who will protect your data.

(b)       Information You Instruct Us to Share. 

You may be presented with an option on our Service to have us send certain information to third parties or give them access to it. If you choose to do so, your Personal Data and other information may be disclosed to such third parties and all information you disclose will be subject to the third-party privacy policies and practices of such third parties.

(c)       Service Providers. 

We may use third-party service providers to perform certain business services on behalf of us or the Service, and may disclose Personal Data to such service providers as needed for them to perform these business services.  Service providers are only allowed to use, disclose or retain the Personal Data to provide these services and are prohibited from selling Personal Data.  Business services provided include, but are not limited to, hosting services, software as a service, document management services, communications services such as email, text, and chat services, software and website development services, accounting and audit services, compliance services, quality control services, analytics services, call center services, marketing services, employment and employment verification services.

We may also share your information with the providers of analytics solutions services to enable us to use that information in accordance with paragraph 6 above. We may also share your Personal Data when the relevant third party is providing us Personal Data and we need to verify whether their data matches that which we hold.

(d)       Business Transactions.

In the event that we sell or buy any business or assets, in which case we may disclose your personal data to the prospective seller or buyer of such business or assets.  If Infopro Digital or substantially all of its assets are acquired by a third party, in which case personal data held by it about its customers will be one of the transferred assets.

(e)       Legal Process.

If we are under a duty to disclose or share your personal data in order to comply with any legal obligation, or in order to enforce or apply our rights, to view our terms and conditions of use and other agreements; or to protect the rights, property, or safety of Infopro Digital, our customers, or others. This includes exchanging information with other companies and organisations for the purposes of fraud protection and credit risk reduction.

(f)        User Disclosures.

Some Personal Data is disclosed as a matter of course as a result of your use of certain Services.  Any Personal Data shared via any public forum using the Services or on another website (such as Facebook, Google, LinkedIn, Instagram or Twitter) may become public information. We cannot control the use of information disclosed in these public forums. You should exercise caution when disclosing information in these public areas, especially your health information and location data, and be careful how you disclose your Personal Data. Content posted in public areas of the Services, including advice and opinions, represents the views and is the responsibility of those who post the content. We do not necessarily endorse, support, verify, or agree with the content posted. How long we retain your data

We retain your Personal Data for the minimum period necessary to make use of it in accordance with the provisions of this Policy. We do not usually retain any Personal Data for more than three years unless the information is stored on contractual, legal or financial documents that we need to retain for longer periods.

Your rights under GDPR:

You have the right to ask us not to process your Personal Data for marketing purposes. You can exercise your right to prevent such processing by contacting us at info@infopro-digital.com.

Our sites may, from time to time, contain links to and from the websites of our partner networks, advertisers and affiliates. If you follow a link to any of these websites, please note that these websites have their own privacy policies and that we do not accept any responsibility or liability for these policies. Please check these policies before you submit any personal data to these websites.

Access to information under GDPR:

You have the right to request a copy of the information that we hold about you. We want to ensure that your Personal Data is accurate and up to date. California Privacy Rights

California Consumer Privacy Act. The California Consumer Privacy Act of 2018 (“CCPA”) provides California residents with specific rights regarding their Personal Data. This section describes your CCPA rights and explains how to exercise those rights.

(a)       Right to Know:

Upon verification of your identity you may, no more than twice in any 12-month period, request disclosure of the following information:

• Categories of Personal Data we collect.
• Categories of sources from which Personal Data is collected.
• Categories of Personal Data sold or disclosed to third parties.
• Categories of third parties with whom such Personal Data is sold or disclosed.
• Business or commercial purpose for collecting or selling Personal Data.
• Specific pieces of Personal Data we collect.

(b)       Right to Delete:

Upon verification of your identity, you may request deletion of your Personal Data, subject to the exceptions provided by law.

(c)       Right to Opt-out:

You have the right to opt-out from having your Personal Data sold to third parties, if applicable.  As noted above, with your consent we my share your Personal Data with event and webinar sponsors, content providers whose content you choose to view on this website, and carefully selected third parties so that they can contact your about their products and services.  Additionally, like most companies, we allow certain third party advertising partners to place tracking technology such as cookies and pixels on our websites.  This technology allows these advertising partners to receive information about your activities on our website, which is then associated with your browser or device.  These companies may use this data to serve you more relevant ads as you browse the internet.  Under some state laws, this type of sharing data may be considered a “sale” of information.  You can opt out of this sharing by clicking on the “Do Not Sell My Info” link on our website.  Infopro Digital has no actual knowledge of any sales of Personal Data of minors under 16 years of age.

(d)       Exercising Your CCPA Right to Know or Delete:

If you are a California resident and would like to submit a CCPA request, you or your authorized agent may:

• Contact us by calling our toll free number 1 855-601-3888, or
• Initiate a request by completing our online request form.

Please note that these rights apply only to select California consumers and exclude job applicants, employees, and business contacts.  Only you or an authorized agent registered with the California Secretary of State that you authorize to act on your behalf, may make a verifiable consumer request related to your Personal Data. You may also make a verifiable consumer request on behalf of your minor child.  Except where you have provided an agent with a Power of Attorney pursuant to Sections 4000 – 4465 of the California Probate Code, when using an authorized agent you must: (1) provide the agent with signed permission clearly describing their authority to make a request on your behalf; (ii) verify your own identity; and (iii) directly confirm that you have provided the authorized agent permission to submit the request.  That agent must also be able to verify their identity with us and provide us with their authority to act on your behalf.

(e)       Verifying Your Request:

The verifiable consumer request initiated by you or your authorized agent must:

• Include your full legal name, company name, phone number, and email address that you used to register for any of our Services.
• Describe your request with sufficient detail that allows us to properly understand, evaluate, and respond to it.

We cannot respond to your request or provide you with Personal Data if we cannot verify your identity or authority to make the request and confirm the Personal Data relates to you.  Making a verifiable consumer request does not require you to create an account with us.  In order to verify your identity, one of our representatives will call you at the phone number provided.  You may need to provide additional information in order to verify your request, such as recent transaction information.  Depending on the nature of the request, we may require additional verification actions be taken, including but not limited to providing a signed declaration under penalty of perjury that you are the consumer whose Personal Data is the subject of the request.  We will only use this information to verify the requestor’s identity or authority to make the request.

(f)        Response Timing and Format:

We endeavor to respond to a verifiable consumer request within forty-five (45) days of its receipt. If we require more time (up to 90 days), we will inform you of the reason and extension period in writing.

We do not charge a fee to process or respond to your verifiable consumer request unless it is excessive, repetitive, or manifestly unfounded. If we determine that the request warrants a fee, we will tell you why we made that decision and provide you with a cost estimate before completing your request.

(g)       Non Discrimination:

The CCPA provides the right to be free from discrimination if you choose to exercise your rights under the statute, and Infopro Digital will not discriminate by:

• Denying you goods or services.
• Charging you different prices or rates for goods or services, including through granting discounts or other benefits, or imposing penalties.
• Providing you a different level or quality of goods or services.
• Suggesting that you may receive a different price or rate for goods or services or a different level or quality of goods or services.

Other California Privacy Rights.

California Civil Code Section 1798.83 permits California residents who have provided personally identifiable information to us or our third-party advertisers and marketing partners, if any, to request certain information regarding our disclosure of personally identifiable information to third parties for direct marketing purposes.  Requests should be submitted via email to sean.hayes@infopro-digital.com and should include CALIFORNIA PRIVACY RIGHTS in the subject line.  We will need your first and last name, mailing address, and email address in order to process your request.  Within thirty days of receiving such a request, we will provide a list of the categories of personally identifiable information disclosed to third parties for direct marketing purposes during the immediately preceding calendar year, if any, along with the names and addresses of these third parties, if any.  Please be aware that not all information sharing is covered by the requirements of Section 1798.83 and only information on covered sharing will be included in our response.  This request may be made no more than once per calendar year.

Your ‘Do Not Track’ Browser Setting. Some web browsers incorporate a “Do Not Track” feature (DNT) that signals to the websites that you visit that you do not want to have your online activity tracked. Many websites and applications, including ours, do not currently respond to web browser DNT signals because such signals are not yet uniform. For more information about DNT signals, please visit http://allaboutdnt.com.  Other third party websites may keep track of your browsing activities when they provide you with content, which enables them to customize what they present to you on their websites.
